Status of DD Form 1805 (Violation Notice)
Many of you have been inquiring about the status the new DD Form 1805, Violation Notice, which is being revised to include a $25 processing fee and a defendant signature block. This form is used by our park rangers to enforce Title 36, Rules and Regulations Governing Public Use of COE Water Resources Development Projects.
The U.S. Army Publications Directorate has initiated action to have the revised form printed and available by mid October. The new form will be sent to the Army Publications Center in St. Louis for distribution through normal channels.
The Central Violation Bureau (CVB) has stated that the existing form can still be used until the new Violation Notice is printed and available. Once the new form becomes available, the existing form cannot be used. Please destroy all old forms upon your receipt of the new Violation Notice. Unlike the interim new form that the CVB provided in small quantities earlier this year, we expect sufficient quantities to be available at the publications center in October.
Ive received a number of messages regarding the new requirement to have the defendant sign the form. In my discussions with the CVB, each U.S Attorneys Office may have a different requirement regarding the signature. I recommend you contact your local U.S. Attorneys office to see what the procedure will be and explain the added safety concerns we have in trying to obtain a signature. CVB said that you could put on the signature line the statement: Defendant Refused to Sign. However in any event, its best to coordinate this with your local U.S. Attorneys office in advance.
Several of you have mentioned that the new form is slightly longer than the existing one (8 1/2 vs. 8 3/8). I verified the size with the Army Publications Office and, unfortunately, it will be 8 ½ long and may not fit your existing ticket book holders.
Ill be monitoring the progress of the printing and will notify everyone when the new form becomes available for ordering from the Army Publications Center.
