Civilian Inmate Labor Policy Memo
Enclosed is a policy memo that clarifies procedures for acceptance of civilian inmate labor
services at all USACE Civil Works project. Former policy included the civilian labor inmate
program under the Volunteer Program. Upon review by Army General Counsel, it was
determined that USACE entities will now utilize the authority provided under 18 USC4125(a) to
accept civilian inmate labor services from Federal Corrections facilities, and will utilize the
USACE contributions authority provided under 33 USC 2325, Section 203 to accept Civilian
inmate labor services from State and local corrections facilities. Acceptance of civilian inmate
labor, whether from federal or non-federal corrections facilities and regardless of the
applicable statutory authority, must comply with the procedures and requirements defined in
this memo.
Please distribute this to Division, District and project staff who may be using
