Endangered Species Act
The Endangered Species Act states that departments and agencies shall seek to conserve endangered and threatened species and shall utilize their authorities in furtherance of the purposes of this Act. The primary mechanisms for implementing this policy are identified under Section 7 and in 50 CFR 402.01, both entitled "Interagency Cooperation." Together, the law and regulation, obligates and provides all Federal agencies the authority to fulfill their missions in a manner that will assist in the conservation of species listed as endangered or threatened under the ESA via means identified in both Sections 7(a)(1) and 7(a)(2). Much of the ESA work we do in USACE under 7(a)(2) and the opportunity that exists under 7(a)(1) affects or has the potential to affect migratory birds.
