Lapse in Appropriations / Government Shutdown

    A lapse of appropriation, otherwise known as government shutdown, occurs when Congress fails to pass funding legislation bills (appropriations bills or a continuing resolution) and the President does not sign them into law. Without funding, many federal agencies must halt non-essential operations, and federal employees may be furloughed or required to work without pay until funding is restored.

    HQUSACE delivers directives and instructions for carrying out specific shutdown operations through Operations Orders (OPORD). The OPORD gives Directors, HQ and MSC Commanders the directive to execute these orders within their Command, and for MSCs to provide further guidance to Districts and the field. Fragmentary Orders (FRAGO) may provide follow on instruction and essential changes should the shutdown persist, or new developments occurs. It is important to note each OPORD is specific to the nuance of each particular shutdown.

    As applicable to the Recreation and Natural Resources Management (NRM) program, specific guidance is typically given as an Appendix to the OPORD. Again, each shutdown is unique, and specific guidance must be developed for each situation.

    While direction and circumstance may dictate the orderly closure of REC areas, each action is handled separately and the Significant Change in Operations at USACE Civil Works Water Resource Projects Policy (2025) requirements may not be applicable.
